Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Swasena (Swasena Foundation, Commercial Registration 7053222639) governing your use of Swasena Shield. Please read them together with our Privacy Policy and Refund & Cancellation Policy.

1. Acceptance of Terms

By creating an account, accessing, or using the Swasena Shield service (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

Swasena Shield is a governance API. In a single API call, the Service detects and redacts personally identifiable information (such as names, national IDs, payment cards, and IBANs) and screens content for harmful material across 6 languages, returning a verdict — ALLOW, BLOCK, or REDACT — together with a retrievable, tamper-evident audit record.

3. Eligibility & Accounts

You must be at least 18, or the age of legal majority in your jurisdiction, with the legal capacity to enter a binding contract. You must provide accurate registration information and keep it current. Each account and API key is bound to a single device; you are responsible for safeguarding your credentials and for all activity under your account.

4. Acceptable Use

You may not use the Service to: (a) attempt to bypass, reverse-engineer, probe, or extract the underlying classification models or their weights; (b) submit content for the purpose of testing, evading, or defeating the Service's governance decisions in bad faith; (c) process content you do not have the right to submit, or that infringes the rights of others; (d) facilitate an illegal purpose; (e) resell or sublicense access to the Service without our prior written consent; (f) exceed your plan's rate limits through automated means designed to circumvent them. We may suspend or terminate accounts that violate this section.

5. Fees, Payment & Billing

The Service is offered on a pay-as-you-go, prepaid basis as described on our Pricing page. Prices are shown exclusive of VAT; VAT is added where applicable under Saudi law. Payments are processed by our third-party payment provider (currently Moyasar); we do not store your card details. Your prepaid balance is consumed as you use the Service — there is no recurring subscription charge beyond what you choose to top up. Fees are non-refundable except as described in our Refund & Cancellation Policy.

6. Free Trial

New accounts may be eligible for a limited free trial, as described at checkout. The trial is not anonymous — it requires a verified account — and is limited to one trial per person or organization. We may modify or discontinue the free trial at any time.

7. Refunds & Cancellation

Refunds and cancellations are governed by our Refund & Cancellation Policy, which forms part of these Terms.

8. Service Availability & Changes

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service, including for maintenance or security reasons, with or without notice, and we will not be liable for resulting unavailability.

9. Intellectual Property

The Service, including its software, models, and branding, is owned by Swasena and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without our prior written consent.

10. Your Content & License

You retain all rights to the content you submit to the Service ("Your Content"). You grant us a limited license to process Your Content solely to provide, maintain, and improve the Service, subject to our Privacy Policy. You represent that you have all necessary rights to submit Your Content and that doing so does not violate any law or third-party right.

11. Privacy & Data

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms.

12. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. Governance verdicts are produced by automated classification models and may contain errors, including false positives and false negatives. The Service is a tool to assist your own content governance and does not replace your independent judgment or legal compliance obligations. You remain solely responsible for how you use the Service's output and for compliance with laws applicable to your own business.

13. Limitation of Liability

To the maximum extent permitted by law, Swasena shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold Swasena harmless from any claims, damages, or expenses (including reasonable legal fees) arising from Your Content, your misuse of the Service, or your violation of these Terms.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses a risk to the Service or other users. Upon termination, your right to use the Service ends immediately; any remaining prepaid balance is handled under our Refund & Cancellation Policy.

16. Governing Law & Disputes

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from these Terms or the Service is subject to the exclusive jurisdiction of the competent courts of Saudi Arabia, unless applicable law requires otherwise.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice — for example by email or a notice on the Service — before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

18. Language of These Terms

These Terms are provided in multiple languages for convenience. In the event of any conflict or inconsistency between versions, the English version shall govern.
